Please read the below-mentioned terms and conditions carefully constituting an integral part of the Participant Agreement for the event. All events advertised on our website and in our brochures are operated by Trekkaro Adventures Pvt. Ltd. (trading as Trekkaro), company registered under the Indian Companies Act,2013 (hereinafter called 'the Company', 'we', 'us' or 'our'), and are sold subject to the following conditions:

USE OF CONTENT All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under licence, by the business and / or its associate entities who feature on this Website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.

You may not sell or modify the content of this Website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organisation’s or entity’s written permission.

ACCEPTABLE WEBSITE USE

(A) Security Rules
Visitors are prohibited from violating or attempting to violate the security of the Web site, including, without limitation, (1) accessing data not intended for such user or logging into a server or account which the user is not authorised to access, (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, (3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or "Trojan horse" to the Website, overloading, "flooding", "mail bombing" or "crashing", or (4) sending unsolicited electronic mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. The business and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

(B) General Rules
Visitors may not use the Web Site in order to transmit, distribute, store or destroy material (a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (c) that is libelous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.

INDEMNITY

The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of trekkaro.com or their breach of the terms .

LIABILITY

User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.

1.Insurance

It's a requirement of trekking with Trekkaro that you obtain full travel insurance cover. You're required to have the cover that includes full medical cover, emergency repatriation and emergency evacuation. We also strongly recommend trek cancellation insurance and insuring against any other travel mishaps such as flight cancellations or delays, loss of baggage/luggage and personal effects, theft, or trip interruption at the time of booking. Travel insurance can be obtained through a travel agent or from online brokers. Please contact us for any further information or advice.

2.Free Trekking Gear Policy (FTG)

This is the first time in the World where trekkers can use expensive trekking gear at Free of cost (without any cost/charge) during the treks only. Trekkaro is the first trekking community in the World which introduced such kind of services for trekkers. We are promoting trekking/hiking at our best. Our mission is to create awareness of trekking/hiking among the people of India. Everybody should know about the beautiful trails of India. There are a lot of adventure things to do in India then why go out of India for it? So trekkers, now Trekkaro and Maujkaro...

What's new with Free Trekking Gear (FTG)?
We are going super crazy with offers and on top of that, we have made the rules quite simple!
1- Free Trekking Gear (FTG) are provided to all users for free-to-use (without any cost/charge) during the trek only on specific trek dates.

2- If you apply for FTG then you will not be eligible for the Free TrekCash and Pay 7=8 offer.

3- Choose FTG or TrekCash or Pay for 7=8 offer as per your requirement before booking the trek.

4- For use of FTG, you need to pay INR 3,000 per person as a security deposit at the time of booking which is completely refundable if no loss/damage is done by the trekker, and INR 200 as the washing charges which are non-refundable.

5- The security deposit will be refunded in your bank account within 7 working days after the trek completed.

6- FTG is a kit which includes Quechua Trekking Shoes (Trek 100), Quechua Warm Jacket (-10 degree Celsius tested), Trekking Pole (Walking Stick), Gaiters and Micro spikes.

7- If any loss/damage of the trekking gears is found after the trek, then the trekker will be charged penalty as per the loss/damage.

8- Trekkaro holds the right to change Free Trekking Gears policy without any prior notice.

3.TrekCash Policy

Trekkers! We, at Trekkaro, think that cashbacks have become passe and the time has come to introduce new measures to provide bigger and better benefits to everyone. To that, we introduce TrekCash, the new way to earn, transact & save on Trekkaro

What's new with TrekCash?
We are going super crazy with offers and on top of that, we have made the rules quite simple!
1- TrekCash can be redeemed for any trek booking made on Trekkaro.com via desktop and web only.

2- TrekCash can be earned up to INR 2,500/- by any user while booking a trek.

3- TrekCash will have a valid expiration date.

4- The customer shall receive a TrekCash in the TrekCash Wallet in user account.

5- TrekCash can be redeemed maximum of 500 on new booking and remaining TrekCash Balance would be reflected in user TrekCash Wallet.

6- TrekCash will expire in 6 months and can be used only after 30 days from the date of issue.

7- TrekCash cannot be transferred to anyone.

8- Trekkaro holds the right to cancel all or partial TrekCash granted to the user by Trekkaro at any point in time without any prior notice.

9- In case of any disputes, Trekkaro's decision will be final.

10- Trekkaro holds the right to change TrekCash policy without any prior notice.

4.Cancellation Policy

Cancellation requests are not taken over the phone.
We understand the frustration and disappointment that comes with having to cancel a trek or have it cancelled. That's why TREKKARO has a trekker-friendly cancellation policy in place, designed to help minimize the impact of cancellations and provide a more flexible approach to planning your adventure.

To initiate a cancellation, all requests must be made in writing by the person who submitted the booking form or done the booking and send to the company's contact via email, with a tax invoice copy at info@trekkaro.com

This policy is effective from August 1st, 2024.

1- Cancellation 30 days before the start date of the trek: Get a refund with 30% cancellation charges of the trek fee.

2- Cancellation between 29 days and 15 days before the start date of the trek: Get a refund with 50% cancellation charges of the trek fee.

3- Cancellation within 14 days before to the start date of the trek, or no show on the start day of the trek: Unfortunately, No refund or you can transfer your trek (same batch date & same trek) to your dear one OR apply for TREKCASH Voucher (Total fee paid) 14 days before your trek date which comes with 1-year validity.

4- If you used a voucher to register for a trek and now want to cancel, the cancellation policy applies. If there's a remaining balance after paying the cancellation charges, it will be credited back to your TREKKARO account. However, if the voucher's validity has expired at the time of cancellation, you won't be eligible for a refund, voucher extension, or any other compensation.

Note:-
a) Change of trek batch date is dependent on the availability of seats in the batch.
b) In case of transferring a trek to your dear one, he/she should satisfy all the mandatory requirements laid down by Trekkaro.
c) Trekkaro holds the right to change/cancel the policies, without prior notice.

Once the trek has commenced, there will be no refunds or vouchers provided for unused portions or services for any reason. Any changes or early ending or departure from the trek will be at your own expense and liability.

In the event that your trek leader sends you down from the trek, this may occur due to various reasons such as lack of fitness, failure to maintain a safe turn-around time, altitude sickness, blood pressure issues, or other health concerns, or if you are found drinking or smoking during the trek or breaking the rules of the trek. Additionally, you may also be sent down if you decide to quit the trek on your own due to personal reasons.

Refund Policy
The applicable refund amount will be processed within the 10 working days.

If we have to cancel/suspend your trek before the date of departure or at the last moment due to natural calamity or unforeseen circumstances (continuous rain or snow, snowstorms, thunderstorms, floods, landslides, earthquakes or any other natural calamity that prevents us from conducting a trek safely) or OR unexpected situations like political unrest, curfews, local riots, pandemics, lockdowns, government orders OR any other issues that affect the safety of the whole group, TREKKARO will issue a TrekCash Voucher for the total fee paid, redeemable within 1 year on any of our treks, with the requirement to pay any price difference for a higher-priced trek. The voucher will be generated within 10 working days and sent to your email address.
Note: In instance of exchanging a TrekCash Voucher to your dear one, he/she ought to fulfill all the obligatory necessities set around Trekkaro.
